Not Just Dog Owners
There are other parties that can be held liable for a dog-bite injury. These parties include:
- A kennel, dog sitter or pound
- Parents of minors
- Property owners
- Landlords or property management companies
In states that do not have dog-bite laws, an injured person must prove the dog owner knew (or should have known) that the dog was dangerous, meaning the dog has:
- attacked with or without provocation.
- attacked another animal resulting in serious injury or death.
- been used in the commission of a crime.
Although most animal attacks pertain to dogs, there are other animals that cause injuries, such as horses (kicks), snakes, birds, and ferrets. These attacks are covered under strict liability laws.
“But I must explain to you how all this mistaken idea of denouncing pleasure and praising pain was born and I will give you a complete account of the system, and expound the actual teachings of the great explorer of the truth, the master-builder of human happiness. No one rejects, dislikes, or avoids pleasure itself, because it is pleasure, but because those who do not know how to pursue pleasure rationally encounter consequences that are extremely painful. Nor again is there anyone who loves or pursues or desires to obtain pain of itself, because it is pain, but because occasionally circumstances occur in which toil and pain can procure him some great pleasure. To take a trivial example, which of us ever undertakes laborious physical exercise, except to obtain some advantage from it? But who has any right to find fault with a man who chooses to enjoy a pleasure that has no annoying consequences, or one who avoids a pain that produces no resultant pleasure?”

You are nervous and upset and just want the ordeal to be over. But, what happens if you get a bad outcome? Is it medical malpractice? To know if you have a medical malpractice case, you need to have proof that the doctor was negligent.
At Saffren & Weinberg, we can determine if you have a medical malpractice case.
Medical malpractice is when a physician is negligent in providing standard care and his or her patient is injured as a result. What exactly is standard care? Standard care is what the medical community agrees upon for what diagnostic tests and treatments that are appropriate to your condition. A doctor must make decisions that align with what the medical community finds acceptable.
When there is a bad result from a surgery or treatment, a patient cannot sue for what could happen, only for what did happen. The patient must prove that there was poor standard
